Summary:
The Respondent provided a payment dispute as a basis for not providing a record of work, this is not considered a good reason for not doing so by the Board. The Respondent is found to have failed to provide a record of work as required by the Building Act 2004. The Respondent sought payment from the Complainant that were inappropriate due to a dispute with another party. This evidence before the Board was sufficient to establish that he had brought the LBP Scheme into disrepute. The Respondent is ordered to pay a fine of $3,000 and pay costs of $2,000.
