Recent determinations – August 2026
Determinations are legally binding decisions made by the Ministry of Business, Innovation and Employment (MBIE). They are for matters of doubt or dispute to do with building work outlined in the Building Act and the Building Code.

2026/027: The compliance of a pool and associated pool deck with Building Code Clause F4 Safety from falling
This determination considers the compliance of a proposed new pool and associated pool deck with Building Code clause F4 Safety from falling without a barrier being installed.
The determination considers whether a barrier is required to reduce the likelihood of accidental fall from either the pool or pool deck.

2026/030: Compliance of a Unit without a Type 4 fire alarm system
This determination considers whether a two-level Unit, in an existing commercial building, would comply with the Building Code without a Type 4 alarm system.
The existing alarm system was installed as part of a building consent application, after an intermediate floor in the unit was enlarged in area. The determination considers whether the evacuation time allows occupants to move to a place of safety in the event of fire.
